A thought about parts of the TruckersMP rules

Dear TruckersMP team and community,

 

It has come to my attention that the TruckersMP rules at least in its present version of November 30, 2020 contain some wording that, to my understanding,  is self-contradictory.
In particular, I am referring to "§2 Game only rules" and its subparagraph "§2.5 Reckless Driving".

§2 Game only rules

Rules marked with an asterisk (*) do not apply on Arcade servers with 'Arc' or 'Arcade' in their title. Traffic laws and road signage must be obeyed. This means European road laws and signage must be followed in ETS2 and American road laws and signage must be followed in ATS. Failure to adhere to the respective road laws and signage could result in a punishment. Traffic lights and stop signs can be ignored if no other users are in the immediate area. Also, overtaking is allowed if no other users were put in any risk of an accident. Speeding, while allowed, is not recommended. Speeding can lead to accidents and can factor in a punishment decision. If you have the right-of-way or another player is in the wrong, you must make reasonable efforts to avoid collisions. Baiting other players into accidents will not be tolerated and is punishable.

 

 

According to "§2 Game only rules", all players are required to obey the national traffic laws and road signage of Europe respective America.

In the light of the above it consequently is a contradicting statement to tolerate the non-compliance of traffic lights, stop signs, overtaking and speeding, as they are all regulated by either national traffic laws or road signage or both.

Driving in such a way that is considered unsafe and that puts other players in danger. This includes but is not limited to: driving backwards, ignoring traffic lights or road signage, speeding, racing other users (except in Tucson, Phoenix, and Södertälje (ProMods) racetracks). Driving outside of the map boundaries or in areas that are not covered by the mini map/GPS. Hidden roads which are intentionally part of the map are not included. You can use these roads. In ProMods, you can drive on unlocked roads or paths. Attempting to use desync lag or quick saves in order to cause damage to another user's vehicle. Using the ghost mode feature to go through traffic jams.

 

 

In contrast, "§2.5 - Reckless Driving" penalizes in particular the non-compliance of "[...]traffic lights or road signage, speeding, [...]" which according to §2 Game only rules" are tolerated, even if only on certain conditions.

 

Note:

I know and understand that many aspects are considered if and how a perpetrator will be penalized.
Also, nothing could be further from my intentions than to undermine the TruckersMP policies in a way that others could find a way to abuse them.
As a matter of fact the first and foremost goal of this post is to dispel any of my and or others doubts and with that to make an important contribution to the TruckersMP community.

So the ignoring traffic lights or road signage, speeding in §2.5 is put there so that in case that you do drive 110km/h in a way that is reckless, we can ban you for it. That way you cant just go but §2 says its allowed. Same goes for the lights. If other people are around and you drive out in front of them when they have green, we have §2.5 to ban you with. So most of the stuff in §2 is on the conditions that its done safely and Traffic laws and road signage must be obeyed, is there for when you cause trouble when not doing so. So if you overtake in a way that is unsafe like when there is oncoming traffic or if you overtake on the grass/emergency lane or overtake a queue of people then you can get a ban. But as long as you do the stuff safely, you can drive through a red light or speed or overtake or ignore a stop sign. And §2.5 among other is there in case you cause trouble while doing so.

 

So §2 is sort of there to tell you that Traffic laws and road signage must be obeyed but you can in some cases ignore them if you do it safely. And §2.5 is among other there to ban you with when you dont do it safely.

In an aspect overtaking on the grass verge or hard shoulder (emergency lane) is a reckless driving offence which indeed can and should be punishable however, I've not only seen but also heard of numerous players being banned for doing so unintentionally after swerving to avoid a player in front who has either lagged, crashed into another player or stopped for whatever reason...If players are following too closely or at an excess amount of speed which would prevent them from slowing down or stopping in time to not go into the back of another player then they are bolloxed unless lane 2 (overtaking or acceleration lane) is free of traffic, then they can safely avoid the player in front yet if the lane is live with traffic then the only option is the grass verge or emergency lane (hard shoulder).

If players are swerving or countersteering to avoid the player in front, that player in my opinion should not be penalised for it.

But you said it your self. They are driving too fast to stop or they are driving too close to someone else, that they cant stop in time, so they have to avoid the player by either overtaking or going right. That would be considered reckless, because you should of cause always keep enough distance to the person in front, so that you can stop if they all of a sudden stop or lag. If you cant do that you are much likelier to cause a crash. And its dangerous to drive that close to someone. It happens all the time. Plenty of people get banned for ramming into the back of someone else cause they did not keep enough distance or where speeding. Its not that hard to do. Slow down or just keep greater distance.
